Description of Practice

This Mediator is Certified
Family Finance, Land Use and Real Estate, Construction and Contracts, Environmental Conflicts, Business Disagreements, All these disputes require understanding. Understanding requires experience. Wallace Kaufman has a broad background in helping families arrange finances, in business management, in environmental organizations, foreign aid, and facilitating both small and large meetings.

His personal experience of client interests includes farm and factory labor, university teaching, forming and dissolving businesses, operating a licensed construction firm, and years of work as a land developer, real estate appraiser, expert witness in property disputes, court appointed commissioner, and resident adviser to a Central Asian country on housing and land reform. He has worked in Eastern Europe, Russia, Central Asia and Latin America. As a widely published writer Wallace Kaufman also brings creative and precise language to the service of defining problems and describing solutions.

Professional Background

When Wallace Kaufman left teaching at Duke and the University of North Carolina at Chapel Hill after nine years, he created a real estate business that both pioneered environmentally sound land development and green home building. His business broke through racial discrimination and price fixing in the industry. In the mid 1970s he began to specialize in property valuation and land use disputes. He has served on several county and state level task forces and committees to explore solutions to environmental and housing issues. He also provided expert witness testimony in many property cases that ranged from the impact of airport noise to professional ethics. He has advised lawyers on how to structure value claims narratives in property disputes. As a Realtor he served on the grievance and standards and ethics committees. His knowledge of natural sciences and environmental issues served him well as president of three statewide environmental groups in North Carolina.

He began mediating and arbitrating in the 1980s. That work has included conflicts in business dissolution, divorce property distribution, valuation disputes, and service as a court appointed commissioner in eminent domain cases.

Understanding and neutrality mean that I will never mediate a case where I do not have some personal and practical knowledge of the issues or where I cannot be a reliable neutral party. Understanding includes the emotions that often come with disputes, but I consider helping the parties reach a quick and satisfactory solution all the therapy I can provide. I offer the parties a structure, a clear process, and suggested ground rules but always invite them to modify these elements for their own comfort. I will do two party, multi-party, shuttle, phone or cyber mediation. As a professional writer and editor I strongly believe in starting mediation by framing the questions clearly, fairly, and accurately. My experience also serves well in framing and wording agreements that: 1/ Accurately reflect the full solution; 2/ avoid ambiguity; 3/ eliminate future conflicts on the same issue
